Adding my kid in India to my GC processing

Hi,

My and wife's EAD/AP are approved and 485 is pending. I have a new born baby in India. How can I add my kid to my GC processing? Please let me know.

During your adjustment of status include your child’s name in the application and present the birth certificate along with you application. Also, ask the immigration office to send the information about your adjustment to the Consulate/Embassy in your home country. The consulate/Embassy will issue a “Transportation Letter” for your child to enter the United States and your child will automatically become a Legal Permanent Resident.

If you child is born in the United States and living in India, just carry the birth certificate and travel back to the United States.

ditto what everyone else said

however if no one is a citizen and you already sent the paperwork before the kid was born you may have to file another i-130 and have the first one voided, but I would call either the cis office or the us embassy there first.

During your adjustment of status include your child’s name in the application and present the birth certificate along with you application. The consulate/Embassy will issue an immigrant visa under your visa category and state it as "Following to Join" upon entery into the United States your child will be a green card holder.

If you child is born in the United States and living in India, just carry the birth certificate and travel back to the United States.

I have a situation that is similar to the above

My wife was 3 months pregnant when we went to India in february 2006 on a trip for some family function. We both have Pending 485's, Approved EAD's ( she is not working) and are using Advance parole for Re-entry. We were supposed to return together in March. However due to some medical issues she cannot return to US now due to which our child will be born in India.

What are the options available for us to bring in our child. Any specific documentation required? Please suggest what we should do to make this a less painless process..

desperate for some advice.. sleepless nights

If so your "kid" (child) may be a UC Citizen too.
The OP clearly mentioned that I-485 is pending for both him and his wife

FTJ is only for permanent residents and is not applicable in this case.

You need to first find a way to get your baby into the US and then worry about adding your kid to your GC application. Im not sure if i have an answer for you, but meanwhile, you may want to post this question in the EB GC forum as i have a feeling that you will find others who have been through a similar situation. I will let you know if i find anything. Good luck!

How can the child become a permanent resident when the parents have their I-485 pending?
