Hi

I am new to the forum and very confused about the whole process.
If I am posted this message in the wrong thread, please do let me know.
I am currently applying for my LCA and my other half and I are thinking of getting married.
I was wondering if someone could tell whether we have to be married before adding my "spouse-to-be" on my 485 or we can add the "spouse-to-be" to my 485 and get married within 6 months.

Thank you for your help -

Labor Certification...you must go to the employment based forum, since the procedures are a little bit different.
Good luck,

gcquestion77,

You can add spouse anytime before your I-485 approval.

It is better to do along with your application, though.

Thank you for your replies.

I am currently on an H1B. When my 485 is filed an pending, will I still be on my H1B visa or will my status changed?
If my status does not change, I believe I can still travel, but if my status changes, I will need to wait for the advanced parole.

If you have valid H1 status, you will be considered in H1 status as long as:

a) Job is not terminated by employer who originally submitted H1 petition.
b) You don’t use EAD to continue with current employer or to get new employment
c) GC is approved
d) Changed your status to other Non-Immigrant visa
