I filed my I-485 back in Oct. 2001, got married in May 2002 and brought my wife here in H4.

Talked to my lawer, he said she will definitely get a interview because she is added after 485 was filed. Thus my application will be delayed.

I'm thinking to file it myself. Is it easy to do???

Anybody with the similiar experience care to comment??

Thanx,

what i understand is your wife application will be treated sepratelt then yours. even her approval will come later. YOu have to make sure all the paperwork is attached with her application including ur I140 approval , labour approval etc . Or if she's got more time on H4 and u have time on H1 then she can wait provided she doe't want to work on EAD. Octtober cases have started to get approved at CSC hope u will get that soon. Where did u file ur 485 ?

You must add your wife to your 485 application IMMEDIATE!!! If you don't, and if you are approved now, she will be out of status (no greencard, no H4) and will have to leave the country. Your H1 and her H4 will be automatically nullified.

Do you want to live here without your wife?

I held back my 485 application last year until I got married and have the proper paper work (marriage certificate). I brought her in on H4 and then filed 485, just to be safe.

Your lawyer should have known better than that!!

ghost-rider,

Your info is not quite accurate. The fastest way to get a greencard for your wife is to file 485 together (or add her name to your application if you have already filed). Once the 485 is filed, the applications are considered separate (i.e. her approval may come later). But if you don't add your wife's name to your 485 application and your 485 is approved NOW, she WILL not get her greencard. You will be in deep trouble...

Do yourself a favor, add her name ASAP...
