My dad's sister sponsored my dad for a GC as far back as 1988.
I believe this is the 4th preference Family Category sponsorship
by a US citizen who is a family member.
In 2001, the application became 'current/approved' and the INS
had sent the petitioner (dad's sister) a notification that my dad
could obtain his GC. However, since the process took so long, my
dad didn't think he'd make use of the GC anymore (due to old age)
and felt that someone more deserving should be given this
opportunity. As a result, he notified his sister to 'withdraw/cancel
his application'. My dad's sister sent the INS a letter requesting
that they CANCEL the petition. The INS promptly sent a response
in the form of a document indicating that the application had been
successfully cancelled/withdrawn. The petitioner (dad's sister)
sent this document to the beneficiary (my dad) but it was neglected
and eventually misplaced.
My dad went to a consular office abroad to obtain a visa to
come visit me. Unfortunately, at his interview, the consular
officer requested for this letter/document that acknowledged
cancellation/withdrawal of the original petition for the GC app.
Since this document was not available, the consular officer
stated that the visa could not be issued unless this letter was
made available and suggested that she was giving dad a second
chance and not formally 'stamping a reject' on the passport.
Question is...
1. Is there a specific term for this document? e.g. an i-123
2. There is no way I can get the receipt number. Can the INS
do a search/lookup for a document based on petitioner's name,
applicant's name and date of petition? Who do I contact to
obtain a duplicate of this document?
