Hi all, I applied for I-485 in May 2006 and it got stuck in namecheck.
In Oct 2007, I used my EAD to switch to a new employer. I didn't have my new employer send an AC21 letter to the USCIS.
Now the old employer is threatening to withdraw the I-140 and I-485 applications and send a notification to the USCIS that I'm no longer with them unless I return. (Yeah, it's a consulting company).
Can my old employer hurt the 485 process? Should I preempt him and send an AC21 letter thru my new employer? Will this ward off any negative effects that the old employer can inflict?
To add a little bit of fun into the situation, my new employer is in trouble due to the bad market conditions and is contemplating layoffs, including me.
Hence I'd like to keep an option open wherein I can go back to my old employer if need be.
Any advice/suggestion?
