AC21 when Future Employer files GC

Can I request to have my question answered by an Attorney or Paralegal please?

When my future employer files for my 485, the rule, "working for him for atleast 180 days" doesn't arise at first place.

Since I dont' work for this employer who is NOT holding my h1 and I only work for him after GC is approved, does AC21 apply to me? Can I start working on EAD as soon as I get EAD approved, without waiting for 180-day expiry?

If you want to work with the GC sponsoring employer after you get your EAD, then certainly YES, you can go ahead and work with your GC sponsoring employer on your EAD. YOu don't have to wait for 180 days at all. (My own personal experience, I checked with my lawyer )

What is your intent exactly ? Do you want to work with GC sponsoring employer or some other Employer ?


But hey , again, don't go by what I say, I am not a lawyer, I always check with my lawyer before I take any action on such matters. And I would also advise you to do the same.

Getting public opinion is no harm so that you know what is the general trend but its good to take professional advice especially in complicated situation.
