Wanted your advice on using AC21. I am switching employers. Have an approved I140 and I485 has been pending > 180 days. Am moving to a similar job - the position title does vary and the pay is higher than the LC. Current EAD is valid till 04/2005. Should be a straightforward AC21 case. My question is:
1) Should I send BCIS a letter immediately (through a lawyer?) informing them that I have changed jobs and intend to use AC21. That might trigger a transfer to a local office? Or should I just wait and see if the approval just comes through without informing them.
2) If I should send a letter, is engaging a lawyer necessary (I will have to pay myself - not billed to new employer). I saw sample letter formats posted on the forum and could use them myself.
3) In the lucky scenario that my approval comes through in the next few days (My LUD changed twice in the last week) - how does that impact my intent to use AC21. In this case, my approval would come through before I join the new employer but I would be quitting the sponsoring employer within days of the approval.
Would appreciate your thoughts and experiences.
