The regulations for AC21 are not vague . . . THEY ARE NONEXISTENT. There are no regulations for AC21. The law itself puts no restrictions on its usage and therefore it would appear from the wording of the law that it would apply to EB-1ORs but that may not necessarily be the case if/when the regulations come out.
There is no clear, definitive, answer. Many attorneys act like the answer is 100% clear, and they can argue from the law itself that is is, but the law is not the regulations and if the law was deemed sufficient, regulations would not be necessary.
