AC 21 RFE: PLEASE HELP !!!

Here's the problem.
I worked with Employer A until April 2003. My LC and I-140 got approved through this employer.
I filed my EAD in Oct 2002.
My salary was $75K but due to market circumstances they could pay me only 45K for 2002. All the prior years were as per the requirement.
I got my EAD in Jan 2003.
Employer A was a consulting company and I could not get contracts with them after March '03. So I went with a W2-employment with Employer B until July '03 on a W-2. I reached an understanding with Employer A that officially I am going on an extended leave for 6 months while I worked for Employer B.
In July 2003 I actually landed a full time job with Employer C. Since I had already completed 6 months on my EAD, I officially switched employment and I even sent a letter to INS saying that I have switched employment.
Now I have a RFE to deal with.
They need past tax returns and W-2s. Can CIS reject the application based on
1. 2002 salary by Employer A being less than what they had projected or does that not matter now as I work for Employer C anyways who pays me more than the requirement?
2. Secondly, that there was a gap of 3 months between April and July, I was on extended leave and was not drawing the full salary.
I have my lawyer but I also wanted to gain helpful information from anyone that can help.. PLEASE HELP!!
