AC21 regulations for job change

Y'day I had a appointment with attorney (paid consulting) from Law office of Sheela Murthy regarding my change of job issue.

As per the lawyer, I can change the job anytime provided my job description and duties are matching with the new employer. Salary is not the criteria , it should be above the proverty level. But I do have to notify INS regarding my job change to avoid any future discrepancies while applying for citizenship and this is very important as INS may raise this question " Why u didnt worked for sponspored employer"

Also LOSM received many approved AC21 cases as they send some package to INS (not sure what this means). Lawyer can be changed any time before approval to handle RFEs, AC21 and interview xfer cases.

LOSM charge $2000 (for principal and spouse) for all 485 cases, FYI.

This is just for information purpose. Hope this helps to those who want to apply AC21 rules.
 
Thanks for this. Very helpful. I have asked a couple of times before regarding the implications of changing job after GC if one is NOT applying for citizenship. Do the same rules apply?

Thank you also for posting the fees charged. I have to pay back employer and would like to know how much roughly I might owe. My lawyer guessed at $7,000.

I dont think then it matters to notify INS regarding job change as ur not going for citizenship.

so after we got 485 approved and change job after 3 months it ok ? or 3 months are not good enogh
one more question what if employer dont pay you money stated in LC does ins knows bout it and can revoke GC ?

bout changing job before 485 is approved can we change in between time of rfe issued and 485 got approved do we still have to notify INS ??

any inputs ?

To be on safe side, it is always better to stay with sponspored company for atleast 6 months (better 1 yr)

INS is not concerned how much ur making now, provided it is above poverty level and not become a public charge.

If the RFE is for paystubs or employment letter, then it is advisable to stick with ur employer and send the same to INS. Any other RFE, u can change jobs and notify INS abt ur new employer to avoid problems at later stage (applying citizenship or so)

I have couple of questions. Hope you have some clude:

You talked about change job after 180 days. do you know if there is a chance for perople who chance job before 180 days.
Also, you talked about charge. $2k for just helping with REF?

My RD is 10/23/01. I changed job before 180 days. I have a new H1 with current employer. i am assuming that i will get a REF soon. If that is the case, how much the lawyer shella will charge me and what the chance is to get an approal?

I am not sure about changing jobs before 180 days and its consequences. My suggestion is to catch hold of good immigration lawyer to transfer your 485 case.

Your approval is around the corner so u may have to act fast before u get approved. As per LOSM, they are charging around 2K for 485 case and also it depends upon ur case.

Also, my case was approved ..i used AC21 regulation. Mentioned it clearly in employment letter from new Employer, sent in reply to RFE .

I spoke to Dana Mellot at LOSM and she mentioned salary is not the criteria but it should be above the state proverty limit. I have couple of questions:

-Can you please give more details abt ur case?
-Did u change employer after 180 days?
-Did u hire any attorney for ur 485 case?
- What was the RFE?
