Hi Guys,
Quick Question?

Suppose one needs to work for a different employer after I140 approved, has EAD and 485 pending more than 180 days, what does he need to get with his new employer to intimate to INS?

Any risk involved with that process for 485 adjudication?

Would the new company need to give a letter to INS stating that he is working in the same field as stated in labor certification?

He still has time on H1B but willing to work on EAD.

Signature on AC-21 letter to be sent to USCIS - that is all.

Risk - none if done correctly.

What is signature on AC21, whose signature? If the labor shows 2 years exp in one field, does the AC21 form that is to be filled now, should have the same wordings of the labor, even though he might still not even work on those technologies.

How soon do we need to file AC21 to INS once we join the new company?

I think hmd/ETA-GC posted a nice one on AC-21 and you participated in that discussion too(perhaps). Make a search.

Signature has to be of your employer/HR. AC-21 should have wordings as on specified on your LC(ETA 750), whatever it is.

If your 180 days of filing of 485 is over and 140 approved, then file it as soon as you can - get auspicous time, break coconut and post it(AC-21 letter and not coconut :D ).

It will be great if anyone can put the ac21 process in steps meaning what kind of information one needs to get from old/new employeer ,what docs needs to submitted to USCIS etc.It helps more.
