Friends,

I know that there are million threads on this. But since this is going to affect me soon I need your suggestion.

My 485 is pending more than a year now and have to get converted to an employee at my client's place NOW or the offer is over for good as the management has decided to do no more recruiting.

Am I taking a lot of risk by converting to the same level and approximately same salary. My EAD is also renewed till 02/04.

If in case of a RFE, what kind of documents can INS ask, that I should be prepared about/with? Is there any documents I still need it from current employer? My wife joined 4 months after I applied for 485 and she has completed 6 months too. Will there be any problem to her case? Her EAD is not extended yet.

Appreciate your suggestions.

As per some lawyers

suggestion, if possible try getting a letter from your current employer that you have no choice other than joining the client. I am sure they will give this letter to save their face from the client. According to the lawyer whom I consulted, this will help in citizenship. If you are not too bothered abt that, you don't need to get any letters from current employer other than just Labor copy, 140 copy and 485 receipt/copy.
Hope this helps.

My attorney suggested to get this (attached) letter from the new employer. Though I have doubts that new company will give any such letter.

THanks,
BR

I changed my job on 10th month after filing 485 and I did file AC21 thru my lawyer as per their insturctions as this will protect you from all the hurdles during citizenship application (as said by roran)

This was my decsision and you may need to consult good attorney for good advise on ur case but I will suggest one thing not to go for company's lawyer for ur remaining GC process as I had a bad experience in dealing with them and they do not give u the basic service as expected and many of r questions remain unanswered. Once again this was my decision.

Abt getting RFE, INS may ask for 6 paystubs and employent letter from ur new employer. Hope this helps.

Roran, BladeRunner, Sam99,

Thanks for your suggestions.

If things move fast with INS and I get my GC, Will my wife have problems with her GC?
Will my new lawyer at client help with out additional documents?.

I want to sort all this before making a decision as I am dealing with two head strong huge client and consulting companies.

Appreciate your help.

If your wife is not the primary applicant, she should not have any problems at all.
Aren't they lucky to have people like us??:)
