AC21 & portability

I am on EAD waiting for GC(Texas Center, filed June 2002)
I got an offer from a big company. Its Immigration representative told me that it is their policy to file AC21 letter for my case. To do that, she needs the ETA750 copy which I requested my current employer for the copy. But in the end, the job offer is off because the company discovered that there will be $1,000-$2,000 involved to file the AC21 letter, an expense not included in the initial hiring budget.

My questions are:
1. Do I usually get my labor certification approval from the lawyer?
2. Does it cost that much to file such AC21 letter? Can it be skipped?

This is a case that slow processing can really affect my life - if I have green card, I will start in 2 weeks.

to answer the first question of my own - The company seems cooperative on that and have requested that from my lawyer.

2. It is a catch 21 situation. I was told by that company that it is considered illegal from their side to ask me to pay for it after I offered for the expense. I think the money, hassel, and timing all made it desirable not to proceed this time - but the AC21 expense was the sole showstopper.

they usually pay for it but this time around they claim it is not part of the hiring budget. It seems really rigid to me
 
I agree with you. But I do not want to spoil the relationship to that degree. For a company with that size with HR in one time zone, and hiring unit in another, it is all policy-driven decision making - if the policy says always file AC21, they will just do it like that. It was disappointing to see it slip away while anxiously waiting for GC...
