AC21 please help!!

Hi guys,

I have a pending I-140/ I-485 since Dec 2003. I live in VA and my sponsor (small fast food pizza place) is from Chicago. After I-140 is approved, can I switch to a local sponsor (bakery)? I am a cook under Eb3 unskilled. What does "same" or "similar" mean in AC21?? If I-140 is denied, can I use AC21 to reopen??

Do not change the job until I-140 approval.

To change the job before I-140 approval your original employer needs provide support in case of RFE and he should not revoke I-140. It is generally suggested that wait until I-140 is approved before changing the job.
AC-21 cannot be used to reopen I-140.

Same or similar job meant be the job description given from the new employer should be same or similar to the job description you provided at the time of filing your Labor.

why are you saying not before 140 is approved. Then what is the significance of yates memo. Especially now with retrogression, no 485 filing what are other options. why can't one use yates memo.
