AC21 - Informing BCIS

I changed my job after being laid off in Oct' 02 using EAD (after 180 days). I haven't informed BCIS about invoking AC21 until now nor have I received any RFE's as yet. What should I do?

Also my previous company is not responding to my repeated requests with regards to faxing me a copy of the I-140 receipt notices or Labor Certificates. The told me they will not interfere with the process but who knows?


What should I do? Should I contact a lawyer to handle this situation? I am also prety sure that we (myself and my spouse) will get Birth Certificate RFE's. Any good one in Chicago?

Contact immigration attorney ASAP and file G-28 ASAP. If you get RFE then your new attorney will get that RFE instead of your company/company attorney.

It is better to inform BCIS about using AC21.

Also your company might give I-140 copy and labor certificate copy if your attorney send formal letter requesting the same.
 
My suggestion as I have learned from

various postings on this site would be - do not volunteer info to INS unless they ask you. So hold on and do not send info on AC21 etc. If they ask then send one.
 
My suggestion would be that you consult with an attorney ASAP. I don't think you would want your RFE letter (if there is any) to go to the previous company's lawyer.
 
don't send INS any information unless specifically asked, you'll just be inviting an rfe when it's your time.

Also, isn't it the company's responsibility to provide you with copies of all your approvals? Did you ask them as they were getting approved at each state? If you are unable to get any information regarding your application, then make a formal request through your own new attorneyand ask your ex employer to transfer ALL the files to him.

Even if they revoke the old I-140, the worst ( i think) the INS can do is send you an employment based rfe asking you to prove that the labor certification approval still holds. Which you can then counter under AC-21 and new job offer. I believe your lawyer will give similar advice.
