AC21, GINNU UN please help.

I 140 approved (2001) from previous employer. (It has not been revoked) Never applied for I 485 as the previous employer was not ready to give employment offer letter and he is still unwilling to help.
Can I now apply for I 485 based on previous I 140 approval wihtout the employment offer letter (from previous employer) , and then after 6 months claim AC21 benefit with employment letter from current employer?
Has anybody successfully tried this method, please help.

I was working for the previous employer when the I-140 was approved in 2001. I quit 3 few months after the I 140 was approved. In hind-sight I should have applied for I 485 at that time (without the EVL) but I did not.

I am and will always remain in legal status due to another on going petition. In case I do apply for I 140/ I 485 and it gets rejected, I will still rmain in status. If it does get approved, then I guess I am lucky.
Any comments will be appreciated.
 
mine was similar case

I got laid off from Comp. A after I-140 approval,
I applied I-485 using CompA I-140 using AC21
while working for CompB on H1
got my I-485 approval with out an RFE - may be I was lucky,
so far so good, I don't know about the future.

if u do apply like me, make sure your I-485 is pending over 180 days
and go thru a noted attornery

In my case the I 140 was approved in 2001. I quit 3 months after that, never applied for I 485 untill now. Do you mean to say that : apply for I 485 without evl, then after 180 days and with help of lawyer, file AC21 request ?

you r right, that's what I meant,
what I meant was, you should see to that
USCIS don't approve(adjudicate) ur I-485 application
within 180 days,

if ur I485 application is pending for over 180 days
then u can avail AC21,

again, don't completely rely on my information
cross check this with ur attorney
