Ac21- Ead Renewal Attorney Opinion

Dear All

I am working as a FTE using AC21-
My EAD expires on Dec 1, Applied for renewal RD Sept 25

Spoke to Immigration Attorney, and she says as long as I have
applied for renewal, I am ok. Just save the receipt, No need to inform employer


Is this correct? please advice

my 2 cents...

I think the attorney is incorrect.

1> Since the EAD expires on dec 1st you cannot and must not work (be on the payroll) on or after said date.

2> Since you have applied for EAD on sept 25 after 90 days (3 months) i.e. dec 25 you are allowed to get an interim ead from you local APC if no decision has been made on your application.

Have few questions..

- Did you received EAD before Dec 1?

- If you did NOT then
did you stopped working as you were NOT having EAD
- Did you scheduled infopass apointment & did local ASC gave you Interim EAD?

Were you able to take infopass? let us know how it went.

I think local uscis is not giving any interim ead. i had infopass, didnt help and now im out of pay my lawyer told i can work with the receipt only if the valid card was lost and I applied for a duplicate. Reason : we do not know how the validity start date will be for ead... whether it is the next day of the expired card or before expiry or whatever the day they are approving... there could be few days with out any valid status eligible for work(other than AOS)
