I have changed my employer after 365 days of pending I-485 and my I-140 is also approved. Now to use AC21 I need an employment verification letter. I have joined the new company on hourly basis and they have given me an offer letter in the same skill set and job description as my Green Card Labor. In the offer letter it is mentioned that the base salary is $x/hr.

If I multiply this by 2080 this far exceeds my Green Card Labor Salary.

I am now getting the Employment Verification letter from my company. Will it be okay if they just mention my hourly base salary in the letter or should they tell the annual salary by multiplying it with 2080.. Since I am working on an hourly basis they may not be willing to give an annual salary amount.

Please suggest if these words will be okay...

Mr. NNNNN is employed with us on Full time basis as [labor title] since
[joining date ]. His base salary is $xx.xx / hour.

His primary job responsibilities are :

If you any further question pl. feel free to call me [hr manager ' nos]

It does not matter if the salary is hourly and also if it is much more.
The job should be 'similar' and it should be permanent- no 1099 and no time-frame.

Thank You for your reply. Can you please clarify if it is mandatory to mention the job is 'Permanent' in the Employment letter. They have given me the offer letter saying that the offer is valid depending on the availability of the project . The H1 is being filed saying its a Temporary Full Time Employment.

I have filed for a new H1 because I need to be on H1 so I can bring my wife to USA once I am married. I don't want to use EAD yet.

Thanks

1. How the H1 is being filed does not matter.
2. In my opinion you can not have words like "...offer is valid if projects are aval..". That most likely will not work. The words permanent and full time (40 hrs/week) must be there. That is the essence of EB-GC.
Good Luck
