I have joined a new company after >365 days of my I-485 filing and I-140 is also approved.
Presently I am on H1 with them as I am still single and need to maintain my H1 status to bring my wife to USA. I do have an EAD, but I am not using it.
I intened to go back to India to get married once I get my Passport stamped with my New Employers visa.
As I still need to maintain my status I need to be on project till I get the I-485 approved. I am worried that the current project with the new employer may end. If that happens and at that time if I use the EAD to get a new project with a new company that will be the 2nd job change for me. ( which I don't want to do ) But if I have to do that, will it create any problem in my I-485 approval. As per law how many times can we change employers after being protable under AC-21 and using the EAD. Do we need to inform BCIS every time we change employers?
I have not yet informed the BCIS about this job change. My lawyer adviced me "not to send a reply until they ask for EVL ( Employer Verification Letter ) .As per the law I am protable now ".
Please advice.
