AC21 and new job

I have a question regarding the portability law. I have completed a year after I filed my I-485 and my company is undergoing a reorg. If I get laid off, I know according to this law I need to find another job in the same city and that the job should have the same job desc. I know of 2 other small consultancy firms that have expressed interest in the past to hire me. However the only problem is that they do not pay while on bench and you get to keep a significant portion of the hourly rate. Does this pose a problem with INS . Are they stricklers about pay and such ?? What if the consultancy agrees to pay the salary but only if land a contracting assignment and nothing meanwhile.
