AC21 - Am I ready ?

Dear Friends,

After a long wait of 13 months, at last, my I-140 was approved on 07/09/2004. My I-485 was filed on 7/9/03, hence I am good to go (I think) for change of Company using the AC21 portability option. I have a question and will appreciate if you can contribute to it.

1.0 I am ready to take a full time position (Same or similar job). What is this AC21? Do I need to fill-up some form or it is a regulation that by default is applicable once 140 and 485 conditions are met?

2.0 My 1st EAD is expiring on 08/06/04. I already have applied for extension on 06/22 and RD is 06/25 and LUD is 06/30. If I join the company today (07/13), what would be my option if by 08/06/04, by EAD extension doesn't come. Will company let me go?

3.0 Do I have option to ask for Interim EAD?

Will greatly appreciate replies.

well Ac21 is the regulation that allows switching employers 180 days after filing for I-140.

There are conflicting recommendations about informing INS about change in Employers. Some say you should others say wait for RFE. so you have to do what you deem best. The job has to be same or similar to the LC description, with salary at least that on LC. The new employer should be willing to provide a letter certifying the long term nature of employment, salary and job duties.


if you kept current on this forum, you would have known that its better to apply atleast 90+ days before expiry of EAD. cause yyou can get interim EAD only on 91st day. So hope that u get ur EAD in time, else by regulations you will have to go on leave.
