AC140 without AOS

Hi everyone,

My I 140 was approved in Feb 2003. But because of J-1 visa regulations I cannot apply for AOS till Aug 2004.

So I want to go for CP @ Mumbai. As I have not filed I 485 yet do I have to still apply for I824 before sending in AC 140?

Also if I do not need to file I 824 then does my attorney have to request Nebraska svc ctr to forward my file via NVC to Mumbai? Is it how this works?

I am confused...what's the right way to proceed for CP in my case.

If you had opted for 485 in your I-140 application or left it BLANK then you will need to file I-824 to route the case to the consulate. And then use the AC I-140 route with I-824 receipt.

If you had opted for CP in your I-140 application then your case will be automaticaly transferred to NVC within 4-5 weeks after I-140 approval!
