My ac140 pkt recahed nwd this week.
How much time should i expect for an interview ?
also when can i expect to get some communication from them ?

also do i need to call up / email the consulate and check the status ?

Please advise.

Thanks.

it should be 3 months ....

so u are looking at Dec for Interview .....

from what I have seen is that NWD usually prefers to communicate with u when they have assigned u the interview date or are about to ....

They are pretty nice over the phone , so u can try calling them between 12:30 - 2:00 am EST

Even my AC-140 papers reached Mumbai on 16 Sept 2002 (morning).

Even though my I-140 was approved with CP option to Mumbai consulate is it really necessary to include the I-824 receipt as a part of my AC-140 papers.

After waiting for 5 business days I emailed (yesterday night) Mumbai Consulate to check on my Interview Date. Unfortunately there was no reply to my email.

if you already have 140 with cp how come you say it is AC140. you are supposed to send ur papers to nvc.

Here is a transcript from the mumbai website:

How do I request consular processing of a pending employment-based case?

On a case-by-case basis, the U.S. Consulate General in Mumbai is accepting employment-based immigrant visa cases for processing when all the following conditions are met:

INS has already approved an E1 or E2 category immigrant visa petition and the applicant has an original I-797 form,
the applicant is a resident of the Mumbai or Calcutta consular districts,
the priority date of the case is current or could reasonably be expected to be current within 60 days (we will not warehouse non-current cases),
waiting for the INS to process the change-of-status application would cause the applicant hardship,
the applicant has copies of all pages that made up the original immigrant visa petition,
there does not appear to be any indication that the case is fraudulent,
I-824 Fee Receipt required.
If you believe that your case meets these conditions, forward copies of your I-140 paperwork to the Immigrant Visa Unit, U.S. Consulate General, 78 Bhulabhai Desai Rd., Mumbai 400026 India with:

the original I-797 Notice of Approval Form
complete forms OF-169 and OF-230, part 1
an e-mail address where we can contact the attorney with confirmation that we have accepted the case
DO NOT send any submissions to any officer or employee by name. Doing so mixes business with personal mail and results in lost paperwork when officers transfer.

We are accepting E3 cases that meet the above conditions on a more limited basis, where it is clear that the applicant is highly skilled. We would accord precedence to applicants who have already received H1-b visas in the same profession or for the same employer.

NOTE: This procedure only applies in change-of-status cases. If INS has approved an employment-based petition and you had asked from the beginning to apply for the visa in Mumbai, then we must wait for the case to arrive from the National Visa Center.

My AC-140 papers have reached Mumbai Consulate on 09.16.02 but there is no reply from them so far. Could you tell me how did you file your AC-140.

I've opted for CP in my I-140 and thereafter w/o filing the I-824 I sent my AC-140 paper to Mumbai. I'm not sure whether I should have done that in the first place. B'coz when I called Mumbai consulate the officer was asking for a BMB number to track down by case. BMB ... no idea what is that. Will try to call once again tonight and dig some more out.

So now if I file I-824 will Mumbai Consulate be able to take a look at my papers.

After all of this ... I'm still confused who is eligible to file AC-140 with Consulates Abroad (from where their passport was issued).

Gurus ... please advice.

You seem to be a confused man.

Did you even bother to read the transcript which I posted?

When you say AC140 it means "Attorney Certified" and one of the most important criteria for this is you need an original 824 receipt(which is a form you fill requesting change from AOS to CP),which the attorney sends to the consulate along with the other I140 papers.

The consulate then sends the BMB number via email to the attorney(in 2 days).

Note:::: "this is applicable only to people who applied for AOS and then planned to switch to CP" ... which is my case

You had your 140 with CP and you should have waited for NVC to generate ur packet 3 with the BMB number which you are supposed to fill, get it reviewed by NVC,which is then sent by the NVC to the consulate.

I am not sure what made you act in such haste? You would have got an appointment anyway in 2 months since ur I140 was approved with CP.

The fact is......................."UR NOT A AC140 CANDIDATE'"!!!!!! ........

BTW do you belong to the mumbai consulate at all????

BMB - stands for Mumbai
MDR - chennai
NWD - new delhi.

Are you taking legal advice or acting on your own????

Better consult your attorney.!!!!mad:

Some people have done AC140 with a 140 already approved for CP but Mumbai's website categorically says that you shouldn't. With the lack of an 824 receipt, I'm guessing your case will be returned to you.

Since your 140 is approved for CP, call the NVC @ 603 334 0700 and see if they have created your Packet 3. If so, follow the instructions on it and you should be able to smoothly complete your CP in 3 months or so -about the same time that a new AC140 will take you.
