I485:
RD:Aug 8th 2001
ND:Aug 14th 2001

I have a question about AC 21.
I filed my I140 first and after a month I filed my I485 taking the advantage of cuncurrent filing .When would I be eligible to use AC21,

1. Is it 180 days after I filed my I485 ?

or

2.After 180 days of my I140 Aproval ?

I have this doubt 'coz I was told that the employer loses control over I140 after 180 days of approval.
Can you tell me how does AC 21 work with cuncurrent filing?.

180 days from RD of 485

Its 180 days from the receipt date of your 485. Its not your 140 approval date.

But technically, you can not change employment until your I-140 is approved. If you have good terms with the employer you can proceed with changing the jobs. But these days lot of employers are revoking I-140s cause they are selling the same labor cert.s to the GC seekers who just started.
