EB3/VSC Labor sub. case. My I140 has been aprroved last year and I485 has been pending for > 180 days.
I would like to switch employers using AC-21 but the hiring process may take another month or so. It appears that my priority date and I485 RD is coming very close to the current processing times and I may get approved any time.
Questions are:
1) What happens if my GC gets approved just AFTER I join the new firm but before I get a chance to send AC-21 letter to INS? Would this mean, I would have to quit the new offer and join the firm who filed my GC?
2) What happens if my GC gets approved just BEFORE I join the new firm? Am I supposed to quit this new offer and go back to or keep working for the company who filed my GC?
3) Also, my title in the labor was programmer-analyst, most probably my title will be some thing different with the new company. According to the new AC-21 memo, does the dot (and other) codes have to be exactly same as the one in Labor? How does INS look into this? I would highly appreciate if someone can please clarify this further.
