In the light of the recent AC-21 guidelines, I have a question. Could the gurus please help me.
--> I filed for I-140 & I-485 in July, 2004 and then was laid off in Aug 2004. I joined a new company in Aug 2004, however the old company continued the processing of the GC.
I received an ability to pay RFE today. My lawyer tells me that all we should do is submit a letter from the new company saying I am now working for them and state the job duties and my salary in the letter. He says that the old company does not need to send anything as the new AC-21 Guidelines say that you can leave the company after six months of filing I-140 and without the approval of I-140. .
Do you gurus agree?
