AC 21 Inquiry and not working for the Sponsor Company

Hi everyone! Any help much appreciated.

So I am thinking to wait another 4 years before applying for Citizenship and plus get married with my long-term girl friend who is born US Citizen just incase they deny or think it is a fraud application that I did not work at all at the Sponsor firm or worst case revoke my GC. I know that will not happen. I can definitely appeal if that happens.

I had a consultation phone call with Rajiiv and he mentioned not to worry too much. But if you want to play it very safe. Just delay for few years and get married and have all employment documents in hand during the interview. That way you are protect at all cost if by chance they revoke the GC. Just be honest and faithful and that should be more than enough. The IO can question you anything, but rarely deny based on employment especially that far behind. But to be safe you should have all the documents ready in hand all the way back from 2008.

Brief background about myself: I did work same and similar job when my GC was pending from 2008 when I was using EAD card. So I believe it considers as AC21 job portability. I don't believe I reported that to USCIS. I don't know if can pull up tax transcripts or pay stubs that far behind during 2009-2012. I will try to find if I can get the tax transcript. Another option print out email confirmation from the job. Will email confirmation be sufficient during the interview. I worked in following job titles. Credit Analyst, Research Analyst in multiple IT and Investment firms. My GC sponsor was for Accounting Position at Investment Firm. I got my GC in 2016.

In addition when I do apply for the N-400 in 2028. I will put job Title current role as Financial Analyst at E-commerce that my Girl Friend Started in 2019. That should be similar to the LC on file.

Also Rajiiv did say being married to US citizen in the application also helps. They are more lenient. They may not like I did not work for the Sponsor but they surely will not revoke the GC.

In addition I can show everything from current job letter, along with pay stubs and last 5 years W2 tax returns if they ask. If they still have doubts I did not work for the sponsor firm. I can truthfully say I called them over the phone in 2016 and there was no job available as they were downsizing and now the fund has closed down. Now currently working as a Financial Analyst at e-commerce brand.

Do you think I have enough documents just incase if I get a tough IO officer.


If anyone could reply to my thread I would greatly appreciate.
