AC-21 Application Details

Hi

This is wiht regards to filing for AC-21 portability for an employment based I-485 Pending case...

I understand that the proof of working more than 180 days ( from the date of ur I-485 receipt date) with the Employer A is necessary.

But do we have to specify in the application when exactly a person did join the employer B.

My case is I got Laid Off from Employer A after 180 days of I-485 receipt date (I-140 is approved and also EAD and AP)

but i have a 4 month period in which I dont have a job.

Is this gpoing to ba a problem. or should I take the approach of waitng for the RFE and then send in the paystubs and W-2's.

my date for I-485 is December 2002.....
so i dont think I will get RFE anytime soon.......

Any advice would be appreciated!!!
 
1. When you joined your new employer is irrelavent- you may state that in your AC21 filing- but not required. The interim period (jobless) does not matter- you are status.
2. Regarding AC21 procedure: As per the law you are expected to inform BCIS of the job change but not required to. Different people do different things - it all works out. You may do nothing till RFE. Sometimes there is no RFE and you get approved.
