AC 21 and 1099 questions

Can I switch employer multiple times by invoking AC21 ?

Once my 140 got approved and 485 was pending more than a year, I left my sponsoring employer and joined another employer by invoking AC21(2 months back), but did not send the AC21 related documents to the service Center. Now I got another good offer from another Employee and I wish to join them, again by invoking AC21. IS this Possible?

Can I go for 1099 instead of W2 with the new Employer?

Here is the details:

Sponsoring Company A, Present Company B, Future Company C.

Left A on end of April, 2005(W2)
Joined B on May, 2005(W2)
Willing to join C from July, 2005 (W2/1099 " 1099 works better if at all permitted).

I am not sure, if you really have to inform INS everytime.

It may matter when you travel on AP, after the switch - but not sure.


As such, looking at your PD dates, 485 dates and the way the USCIS does process/behaves, its better not to wait. May after 3 years USCIS would say, all EB-3 get lost.

At least, you would not repent that , you lost money.

Feel like you should inform INS the first time you change, and then wait for a RFE. Why should inform them again and again and confuse them?

One cannot get stuck with a employer for life.

You need to be on a W-2. (technically on w-2, some tax in already deducted. While on 1099, you need to pay tax) Is that correct????
