AC 21 - Ability of Pay : Need help

I have changed the job after my 485 has been pending over 180 days and after 140 approval. I am in the process of informing USCIS about my change in employer. My attorney is suggesting that I send "ability to pay" letter or annual reports along with EVL and AC21 letter. However my new employer thinks it isn't necessary.

What do you guys think ?

It is recommended but not necessary. If your employer is a well known publicly traded organization, CIS would know their ability to pay and would probably not question you back. However, if you work for a smaller/not well known organization, and you do not send proof of ability to pay, you may or may not get a RFE from CIS about it which can delay ur approval.
