i applied for my AOS in Sept 2002 and am no longer working with the sponsoring employer. I have not yet used the AC 21. Is it possible to go for AC 140 and go for consular processing?
It will be difficult since you will need to file I-824 which if I am not wrong needs to be filed by the company who processed your I-140.
You have 2 things to take care off:
1. first ask an attorney if it is possible.
2. If the answer is No then continue on 485 else convince your previous employer to file i824 so that you can use the ac I-140 route!
