About to file 140/485- Some Qs.

Guys:

I am going to join your family soon. My labor got approved very recently and my lawyer shall be filing for 140/485 soon (hopefully by mid next month). Quick Qs:

- Is there a link on the forum where I can get a list of documents that I should start collecting for 140 and 485?
- What does ND stand for? I understand RD, LUD now
- Are the approvals based on RD or PD? I am EB2 with PD April, 2003
- If I do apply for EAD and all by next month, when can I realistically get EAD so my wife can take advantage of it?
- Wife is on H1B, if she used EAD to get a new job, does that mean she is giving up on her H1B?

ND = Notice Date, The day they generated the Notice (Receipt)

RD, as long as PD is current

1. Form G-28. If filing through a lawyer.
2. I-485, Application to Adjust Status, with copy of I-94 and 2 photographs
3. I-131, Application for Travel Document, with copy of passport identity pages and 2 photographs(Immigration photo).
4. I-765, Application for Employment Authorization, with copy of passport identity pages and 2 photographs
5. I-765 Card. This is your signature card. This is used to prepare you Employment Authorization Card.
6. G-325A, Biographic Information.
7. I-693, Medical Examination, with copy of vaccination.
8. Evidence of valid nonimmigrant status, with copy of both sides of I-94, copy of entire passport, and written summary of beneficiary and spouse nonimmigrant history.
9. Tax returns & W2 for last 3 years
10. 3 latest pay stubs
12. Birth Certificate.
13. Marriage Certificate.
14. Employment Letter.
15. 15. Form I-864 (Affidavit of Support), notarized,completed by principal applicant for spouse and each child

1. Employment letter
2. Employment Reference Letters (if experience required)
3. Degree Cert / Mark Sheets / Transcript
4. Education Evaluation (if required)
5. Copy of I-94
6. 3 latest Pay Stubs
 
is there a place where I can get samples for Employment reference letters? I would like to start working on procuring them.

EAD LUD: 09/21/05 (wife, approved)

11/07/05 - calles USCIS and started enqurity on I140 and it
takes one month to get the feedback)


Any one knows why delay on my I140?

I-485 :
point 8 - too much info. Just a copy of Nonimigrant status with I-94
point 9 - this goes to I-140 ONLY IF you already working for the employer
point 10 - not needed. Too much info might cause problems...
point 15 - not needed. Employment letter is the key, affidavit used in family cases only
I-140
point 1 -goes to I-485
point 3 - again too much info. Notarized copy of diploma is enough
point 6 -is not necessary. What is necessary is TAX RETURN for COMPANY if employs less than 100, other evindence if employe for than 100.

Some people provide as many info as they can get. This tactic might backfire. I would advice to read what is required at www.uscis.gov go to service center link(can do through form page) to which you are going to send your forms and read what is necessary.
