Hello members, I have a question: If a married couple lives apart, can I-751 be approved? Please, if somebody has been in this situation, I would appreciate if can post his/her experience.
My case is that I have the 2 year green card, but I need to move to another state for work and study, but I will keep my address and everything with my husband (the citizen). We are going to be traveling to meet each other, I would like to know about the consequences of this in the future when we have to remove the conditional status.
Please any advise, thank you.

There were some similar cases on this forum before, some of them did get a hard time when filing I-751 and needed to hire an attorney and spent longer time to get their condition lifted. Basically they were just treated same as those who got divorced.

I'm not saying you must get into trouble, yours may go through if you have enough documentation, but if I were you, I'd hold on to the moving plan until the condition is lifted.

Thnk you PraetorianXI and Pricesskate.......I just received the green card mailed to my house on August 6, 2007.....I don't know what I'm going to do. I really want to study in NYC.....I will see if I take the chance because this is a rela marriage anyway.....I was reading a lot and I think if you are into a real marriage and have all the proofs, then there is nothing to be worried about.
Thank you again and I will post what happened.

Similar situation

I am a USC, and I've been married just over two years. My husband is a conditional resident, and we are coming close to our next deadline.

I am considering a divorce. I had to move back home (across the country) last fall for mulitple reasons, and my husband was supposed to join me in feb. His company was bought out, however, and they wouldn't grant him an early transfer.

The problem is I do not want to move back and he does not want to move here. I believe our marriage was good faith, and I'm the one that pushed for it. I know he did not try to "scam" me.

I think the time apart has made us realize we want very different things out of life, some of which we discussed but dismissed as problem to deal with later. He wants children, I don't. We have two very different religous backgrounds. Both of our goals have shifted. We have discussed it, and I think we both feel the same way.

We are very worried what a divorce will do. Several friends told us if we get divorced they will automatically call it a sham and he'll get deported, I'll go to jail. If the marriage was legite and we just grew apart, do we have to stay married and fake it? If I pushed the marriage and I push the divorce, can he get the waiver on the conditional status without me?

i-751

Hi. Can somebody give me a advice. Do I have to send with the application I-751, 2 passport photos. Lawyer says - yes, instructions for I-751 says - no.
Thank you so much, Lucy :)

Hi all,
My application for the I-751 is under 103.(2).b.(18) after we(My spouse and I) had an interview for the I-751. It has been 2.5 years since the interview, and up to date I got no answer form the USCIS. everytime I went to the USCIS office, they tell to come back after six month.
Does any body here has an idea what's 103.(2).b.(18) other than "Withholding
adjudication" Poem, what is about? is it for name check only or it could be for any other reason? is it something bad that will end in denying my application, I don't care about the waiting, I like to know what is it for?
Thank You!

No Lucy, you don't need two passport photos. I just sent my application without passport photos. Read the instructions of the form I-751.
