about concurrent file and H1B

Hi, there,

1. My company will help me to file I-140 in the Outstanding researcher category and I need to find a lawyer by myself. Anyone could recommend a good lawyer to me?

2. I know some benefits of concurrent file of I-140 and I-485, including EAD etc. My question is as following: I just used my 1 year H1 and there is 5 year left. It should be better for me to stay on H1. If I file I140 and I485, I765 etc together, after i get EAD, can i still hold my H1 status?

3. If the above is possible, then is that ok for me to stay on h1 and my wife use the EAD (from concurrent filing) to work? Someone told me that if my wife use the EAD to work, that means the end of my h1. Is this ture?

Hi,

1) The attorney whom can ask for processing your I-140/485/EAD/AP is Law Office of Rajiv Khanna. You can contact him at rskhanna@immigration.com.

2) Regarding your 2nd point you file for I-140/EAD/485. Once you get your EAD as you mentioned you can still continue on H1 visa. No need to use EAD. Your wife can still work on EAD. That doesn't show impact on your H1 visa. If there is a denial or rejection of your 485 process she has to go out of the country and get either H4/H1 stamping and come back thats it. But you can still continue with your h1 visa.
