We are an immigrant family from India residing and working in the <Your city> area for the past six and half years. We have filed for our employment based Green card (I-485) with USCIS - Vermont Service Center. Our case has been pending with the service center since <Your I-485 RD>.
As part of the adjudication process, USCIS requests to collect applicants’ fingerprints for security and background checks. Accordingly, me and my wife have been fingerprinted at the <Your city> INS office on <FP1 date> which have been subsequently cleared by the FBI as of <FP1 received date>.
As we have come to know, the fingerprinting results expire in 15 months. This, in combination with many application backlogs currently at the USCIS and the fact that the fingerprints are not actually stored to a database (as of today), requires USCIS to send out notifications for a second fingerprinting to all I-485 applicants if 15 or more months have elapsed since the first time. This, as the USCIS ascertains, is a required step before approving the Green Card application.
However, it has been close to <months since FP1> months since we have been fingerprinted but haven’t yet received notifications for a second time fingerprinting. We’re concerned because we personally know many other applicants who have applied for I-485 at the same time as we did and/or many months later and yet received the second FP notification (and subsequently approved for Green card). The 800 number provided to applicants does not give any additional information on case status that is not already available through USCIS website.
As sincere law-abiding legal residents of your constituency, we write in great hope to request your office’s help in contacting USCIS – Vermont Service Center to find out the statuses on our cases and if possible, request the department to issue us second fingerprinting notifications.
