Yes. An inquiry can be raised if your RD is 30 days or earlier than what VSC says it is currently processing (as of today, Aug 26, 2004).

Simultaneously, write to your local congressman's office requesting their help in getting a 2nd FP notification. I got mine within 2 weeks of writing a letter to congresswoman's office.

You might want to call ahead to find out who in the office deals with these kinds of requests and address them accordingly in your letter. Here is a format of the letter I had faxed to their office...

We are an immigrant family from India residing and working in the <Your city> area for the past six and half years. We have filed for our employment based Green card (I-485) with USCIS - Vermont Service Center. Our case has been pending with the service center since <Your I-485 RD>.

As part of the adjudication process, USCIS requests to collect applicants’ fingerprints for security and background checks. Accordingly, me and my wife have been fingerprinted at the <Your city> INS office on <FP1 date> which have been subsequently cleared by the FBI as of <FP1 received date>.

As we have come to know, the fingerprinting results expire in 15 months. This, in combination with many application backlogs currently at the USCIS and the fact that the fingerprints are not actually stored to a database (as of today), requires USCIS to send out notifications for a second fingerprinting to all I-485 applicants if 15 or more months have elapsed since the first time. This, as the USCIS ascertains, is a required step before approving the Green Card application.

However, it has been close to <months since FP1> months since we have been fingerprinted but haven’t yet received notifications for a second time fingerprinting. We’re concerned because we personally know many other applicants who have applied for I-485 at the same time as we did and/or many months later and yet received the second FP notification (and subsequently approved for Green card). The 800 number provided to applicants does not give any additional information on case status that is not already available through USCIS website.

As sincere law-abiding legal residents of your constituency, we write in great hope to request your office’s help in contacting USCIS – Vermont Service Center to find out the statuses on our cases and if possible, request the department to issue us second fingerprinting notifications.

2nd FP

Also, in my case I had changed my address and the FP was sent to my old address, although I did change my address with them. The other person staying with me had gone for vacation for 3 months to India and I received after her arrival.
Worth a check if you were in a similar situation.

I am a Feb 2002 filer. I didn't get my 2nd FP yet. I tried in so many ways - calling customer service, calling senator office, sending a mail to Prakash Kathri's office, Expedite request to VSC - but no use.

Which state you are from? If you find out way let me know. Some people were able to walk-in to the local office and gave 2nd FP there. But this won't work in al the places.

I am from Texas service center. I got a reply from the congressman today. Here is the contents of the email. Do you guys think , I might get a 2nd fp shortly??. For some reason i am not feeling cofident.

I have contacted the Texas Service Center in regards to your inquiry. They have informed me that they are presently working applications filed 3/8/02; yours was filed 11/13/02.

Your fingerprints have expired (they are only valid for 15 months); and a request to have you scheduled for another appointment has been made by the Texas Service Center. I do not know when that appointment will be set up, but you should receive a letter of the date, time and place.

Immigration will not allow us to speed up the process of any application, unless dire need can be proved on certain applications.

I will continue to follow the progress of your application and inform you of any changes in work dates.

I am from Delaware.

I haven't tried to go to the local INS office to take 2nd fingerprints without notice.

If you can do so, please post it. Thanks.

I have seen some posts where people did 2nd fp in Boston and Memphis offices without the fingerprint notices. If you have time You can try in Philadelphia or Dover offices. Dover may not be helpful. What I would suggest is go to the philadelphia office and get a hand written 2nd fp notice from them and take it to the Philadelphia ASC. I am not sure will this work or not. It is up to you to decide.

It seems that you are in Delaware, right?

I am also in Delaware, no FP2 yet. RD: May 2002
 
I went to Phildalphia office, they simply said "NO" for 2fp without the notice. I asked them can they give me a hand written notice so that I can take it to the ASC. Thay said it is upto Vermont to decide about seconf fp and they can not do anything about it.
