Ability to Pay on I-140 Question Please Help

My first I140 was denied in 2002 because of the Company tax return RFE(they could not provide it in time.) Now Company has the Tax return from 2001. It is working on 2002 return. I have my W2 from 2003 and pay stubs that show what I should be getting paid per LC. Also the Company has W3s that show what it has paid employees in the past. It can also provide bank statements
etc.

Does the Company need to be profitable? Can I get approved without sending in the Tax return if I can show W2, W3s and Bank Statements?
