Ability to Pay Concern - United Nations & Others Pls reply

Hi guys
I am getting ready to file for my I140/I485 soon. My LC has $70,000 on it was filed in Dec 2002. In 2003 I was paid $70,000 plus. Now in 2004 I am being paid $53,000. Company is very small(7 employees). Annual income must be around $300,000. Company is doing good and growing.

Guys and United Nations pls tell me what are the chances of I140 being approved.

United Nations I referred your excellent link on ability to pay and came to the conclusion that related to my case my I140 would be approved if the net income of my company is greater than 70,000(Prevailing wage in LC) - 53000(Actual wage being paid now) = 17000. So basically the net income of the company should be greater than $17,000 for the year 2004. Pls correct me if I am wrong, I am not very good with finances. Also I would really appreciate your in depth analysis for my case based on the facts that I have provided. This will really help me.

Thanks for all your replies. united Nations I read your detailed reply do you think I would fine overall(considering that I have been paid 70K plus in 2003) or should there be some concern.Also my I140 is not yet filed. the attorney is preparing the same. My employer has sent 2002 and 2003 tax returns. They wont be sending anything for 2004 as they havent filed taxes for 2004. For 2002 i started with them in June 2002 but my labor was filed in dec 15th 2002 so I am assuming that they only have to show ability to pay for the 15 days of 2002 am i right?
