Ability Pay issue - Employer hesitation for annual Report

We are planing to file I-140. My employer is a private manufacturing firm. They are not ready to give annual report, instead they a gave statement for ability to pay (We have more than 100 employees).

Will NSC issue a RFE in this case?

Don't worry about RFE now and hope for the best to happen. With NSC, no one can predict anything. Just wait and watch. Good luck .

Hi mncbabu,

For a company with over 100 employees, a simple letter from the Finance dept is generally acceptable on their ability to pay you the proffered wages. If you are presently receiving the wages as per the approved labor, you should be fine.
