Abandoning GC and starting all over again? Any inputs?

Guys,

One of my friends has a problem with his GC. The situation is he filed for his current GC using BS + 5 years of experience. But, his lawyer didn\'t file his experience properly (She missed out on submitting one complete year\'s experience certificate) when she applied for Labour. He got his labour ok and filed for I-140 and received a RFE reg experince.

He sent the requested information about his experience showing that he has 5 years of continuous exp. but INS declined to process his application in EB2 stating that his "experience was not continuous" and moved his application to EB3. His PD is 08/99.

Now since EB3 dates are not current and it is going to take a long time before they become current, the question is Can he abandon his GC processing and start it all over from scratch from the same company? He lives in MD and vermont center doesn\'t take much time to process labour and 140. His company doesn\'t have a problem with this.

Is this advisable? What are his options? Your input would be greatly appreciated.
