My French National husband and I have two children (the children are French/American) and I am American. We've been married almost 12 years. We bought a home, the builder cut corners and caused serious problems where mold growth led to us having serious illness in our home. Our children were born with rare metabolic diseases that are incurable and can lead to coma, mental retardation, autism, and even death. It is a daily challenge to deal with. So we could not live in that home and evacuated. Our bank decided to foreclose us instead of working with us to forgive the debt as we requested due to circumstances outside of our control. Our insurance and the builders insurance does not cover the mold/construction defects. We got shafted. We now have life-long mold allergies and subsequent health problems even to this day six years later.
We had to leave the area we were in because we became allergic to the mold in the entire region. No one wanted to help us relocate and no one wanted to hire my husband outside of Virginia. His family was also having health problems so we decided to go to France for a year or so in order to help them. After his father was doing better we decided to try to return only to find out that we should have filed a re-entry visa (had no clue) and my husband did not apply for citizenship (there for 6 years!). So we moved to Ireland and he has been working for an American company for the past year. It has now been a little over two years and I am told we have to start over or relinquish the Green Card or he cannot even visit the USA or travel for his company there.
Does he have to also relinquish the social security card? If so, does he get his social security payments he earned for retirement? Do we still have to report to the IRS his foreign earned income if they have asked for him to relinquish his Green Card? In the end I am a bit disappointed that my own country will not help us out given we have always done things legally, and we have experienced extreamly hard financial difficulties and very difficult medical issues which prevented us from being able to come back in two years.
