I have been a permanent resident of the US since 2000. I was eligible
to apply for US citizenship in May 2005. My wife and I applied for
naturalization in advance of the date of eligibility (there is a
90-day period before eligibility during which you can apply) and went
through the fingerprinting and interviewing process.
My wife was invited for an oath of naturalization in October 2005 and
became an American citizen. However, I have yet to hear back from
USCIS about my case. I wrote to them three times since October 2005
and never received any reply. I also went to the USCIS office in
Detroit in early 2006 in person only to be told that my case was still
pending. The automated system of the USCIS still doesn't have any
information about my case even though they are required by law to
adjudicate on a case like mine within 120 days. At this time, a whole
1.5 years have passed since I applied.
I have recently written to a senator from Michigan. I also talked briefly to a lawyer about possibly suing USCIS. When I asked USCIS about the 120 day limit, I was told that this time period doesn't start until they get back my clearance from the FBI.
I am not sure what to do next. Does anyone have any suggestions?
