A very Sad day at Infopass!

Well my Immirgation Depression seeks in, Today I went for my Infopass to see if anything is moving with my "Lost Letter" from the NBC. I got there at 11:15am (right on the dot) and was called up at 12:30pm. The Immirgation Officer was really nice and he told me to go ahead sit down and that he is going to call the NBC to have them Fax the letter to the Service center. At 1:00pm the Officer told me he is going on lunch and that I have two opitons, ether wait til he receives Feedback from the NBC or go home and he will have them send the letter in the mail. I had to stay cause I am not taking any chances on this Oppitunity of getting the letter the same day so I decided to stay, I stayed for 2 hours in the lobby and then something suddently happened...THE COMPUTERS WERE DOWN, PHONELINE AND INTERNET! I couldn't believe it, I was soo upset I honestly prayed. At 3:00pm the Immigration Officer told me that he's sorry and that he wishes he could do something but he said that he would call tomorow morning and email them on them sending the letter in the mail. At 3:15pm he told me to come back in two weeks if I don't receive anything. He also asked me where my mother is and that I told him that she lives in Canada, My Step father is the one who is sponsering me, he looked at me like its an odd case, he told me that he has never ever heard of a Step child being sponsered from a Step parent, it's usually a Biological parent and its child being sponsered by the Step parents, I don't think your allowed to do that but he said that he could be wrong, he looked it up and he said theres nothing that says you can't do that but I guess you might be ok with it. He also noted that I may have my case terminated due to not responding to the RFE, they give you 90 Days and well your getting real close to it. He told me that its up to the NBC to give you that Extention and hopes for the best for me.


So not only I had a bad day at the Infopass appointment but I also have a good chance of having my case terminated. I am really in shock right now and im praying for the letter to come in the mail.
 
Yeah I was 15 when they got married, however the Immirgation officer said that he has never heard of the Biological Parent not being sponsered but the Step Child being sponsered by the Sponser.

Bren - I am horrified by this, by the complete and total incompetency of the USCIS and the total power they have to WRECK someone's life who is honestly trying (AND PAYING!!) to gain legal residence in this country. I know you are in shock, but do not give up. You need to fight back on this and do it vigorously. The waiting at InfoPass is inexcusable. Please call your congressman again, get them involved. I've seen many terrible stories on these boards lately about treatment of potential immigrants; this one is right up there. We are all behind you. Please do not let this drop.. call someone today, call many people today. Keep ACCURATE records, details, names, times, etc. Send your account of this mess to the Ombudsman, congressman, senator and any immigrant HELP group that you can find. Keep us posted... I'm so sorry you are going through this.

Well thank you, I am not the only one that goes through this but hey thats life i guess lol. I did contact my Congressman today and well there they have a Immirgation Worker, she told me that she sent out for more information about my case and for me to wait to see what happens.

I talked to a lawyer today and she told me that I should ofcourse get a lawyer right away and that my mom's papers should be pending cause at the interview they could denie me. My mom right now has a lawyer and she doesnt have a case filed yet due to her Border ban.

I am really frustated.
 
Are you under 21?

According to the info on USCIS.gov, you're eligible for AOS as long as you're under 21 and their marriage took place before your 18th birthday.

Oh yes, Im 18 years old and the marriage took place before my 18th birthday, however My mother lives in Canada and she is not being sponsered by my Step father cause of her Ban. The Immirgation Officer raised his eyebrow saying that he has never heard of a case like that, usually the mother (the biological parent) would be a joint sponser with the Child but he couldn't find anything in the books that said your not allowed to do what I am doing so he said its a toss up I guess.
 
Then I think your application should have no problem at all as soon as your priority date becomes current.

Make a copy of the rules provided on USCIS.gov for your own records, just in case the immigration officer is not familiar with these rare cases, you'd have something to prove that you're eligible. And you might also wanna consult an attorney.
