A tough question

Hi all,

I'm on behalf of my friend writting to know the situation he's facing right now. He went to usa under f1 student visa, but then he was out of status because he took less than 12 units (11 units) in 2 semesters and couldn't get the reinstatement. and he stayed over 1 year after the expiration date, now he will return home soon this week.

He's concerning about whether there's a hard penalty on this sitution. Could he applies for a visa like B1 (come to do business) in the near future(not sooner than 2 years later) or will be banned for a long time (>=3)?

also, could he be arrested on the airport though he didn't commit to any crimes(even not working in usa)

Any answer is welcome.

ok, i just found out that actually he applied for I102 to reinstate his i94 status and was approved on September 8, 2005. He received the denial of resintatement later on.

So does that mean if he leaves now, he won't be arrested in the airport and won't have a 3 year bar of inadmissibility :confused:

also what is voluntary departure? if he leaves now, is that it ?
