Dear All, my employer applied for EB3 in early 2003 and when the dates became current in July 07, my attorney screwed up and couldn't file my 485 on time. They are filing 140 as I write this thread.
My employer also applied for EB1 in late 2006 and I have a pending 140 and 485 as a result. We got a difficult RFE for this case (EB1) and I don't see any reason how we can get a favorable response from the USCIS, if we respond to the RFE.
Now, here is my question. I'm asking my attorney to withdraw my EB1 140 and 485 altogether since they are not going anywhere. Moreover, my PD for EB3 may become current later in the year and when that happens having an EB1 485 may cause issues. We can't link my EB1 485 with EB3 140.
What are your thoughts/experiences? If we withdraw EB1 140/485 (rather than getting a rejection from the USCIS), could it have any consequences on my EB3 485? I already have an A# based on my EB1 485 but that's useless (at least to me ) since as I mentioned earlier, the RFE for EB1 is pretty tough.
