My H1B visa expired April 04. I have an extension I797 valid until Feb 2005 and intend to get my seventh year extension in Q4 of 2004 (that will be for period Feb 2005 to Feb 2006).
I intend to travel to India in Jan 2005 for an important occasion. I know I'd have to get the visa stamped from the US consulate in India. Questions are: Can I get the visa stamped for the Feb2005-2006 extension in Jan 2005? Can I submit the 2005-2006 I94 when traveling out of US even though it is for a future period? If that's not possible is there any downside to using the 2004-2005 I94 and stamping the 2004-2005 visa?
