Hi,

I am from Vietnam and have asylum. I just heard about a new law that allows Vietnamese to bypass the quotas and to receive their GCs right away. Anyone knows what I am talking about?

I think they have special processing times for Haitians, Syrians and Iraqis. I am not sure about Vietnam. Gilbert has talked about a temporary protective states for certain Asian nationals but they are not granted asylum i think
 
There is a special law out there. Can you tell us when and under what status you entered the US? This will determine if you are eligible.

I entered the US in March 1997. I have an I-94 saying something like paroled under ODP. I was granted asylum along with my parents and brothers in 2001.
 
good news for you

I have good news for you. People from Indochina who were paroled into this country as part of the Orderly Departure Program (or from the refugee camps without being granted refugee status first) before October 1997 can submit an Form I-485 whether or not they have been granted asylum.

The best part about this is that your green card under this special law is backdated to your original entry date--March 1997. So the minute you get permanent residence you can apply for American citizenship!!!!!!!!.

The bad news is that only 5000 people can benefit under this law. They have been taking applications since January and I do not know how many have been filed.

So if I were you, I would send out an I-485 TODAY.

Dowload the necessary forms from the BCIS homepage and fill them out now.

Under Part 2, question h of Form I-485, write ``INDOCHINESE PAROLEE P.L. 106-429''.

You have to pay the application and fingerprint fee again. And you must enclose a medical form this time. Do not forget proof of your parole status.

The application goes to the same Nebraska address where you sent your first I-485.

Yes Congress has just eliminated this cap. Individuals approved under this special law can apply for citizenship immediately.

:) Hi, my friend you deserve that situation.. congratulations to you and your family. I think that backed date work only for that cases because in my family case my wife and daughter received their GC backed 1 year...in my case I only received the approval notice when I call to service center they advice me to go to local office, there they stamp my NP and advice me to wait...the LPR stamp is validated for 1 year..."they said if I do not receive my GC during the year I have to reapply for the stamp" It is correct, that is the way? what can I do next...
