A question on I-485 Approval?

What happens if somebody goes for an interview at any local district office and if there is no visa number available for them, do the officer will still approve the I-485 application or not? I appreciate if somebody can answer this question or is there anyone who went for the interview and there is no visa number available and what happened? Did the officer approved your I-485?

From what I know the officer goes ahead and approves the case but cannot issue the GC because visas are not available. I personally know a few people whose case has been approved by the officer but they cannot get the GC because visas are not available. Hopefully once the PDs are current these pre-approved cases get priority and GCs are issued to them.

Is your case EB based or Family based?

Mine is EB3/ April 30th 2001 (INDIA)...hence curious.

When I go for an interview and the officer approves my case without a visa number. Does that mean I become a permanent resident or I become a permanent resident only when the visa number is available? Thanks.
 
How can you become a permanent resident without a visa number? This is 'all or nothing' - no in-between - so obviously 'No'.

until they stamp your passport or you receive the actual green card you are not a permanent resident. Either of them can happen only when VISA NUMBERS are present.

As others have already mentioned, you only become a PR after a visa is issued to your case. Until a visa is issued against your case it is considered pending.

Is it indeed rare to get an interview for EB cases but in '04 a lot of Service Centers transferred EB cases to local offices in order to reduce their backlog. Infact my case was sent to the wrong local office and was recalled after a year. These days most EB cases probably won't get transferred to local offices. In some cases there are specific reasons for TRX such as bad FPs, AC-21 etc.

Hey guys -

I finished my GC interview on September 21, 2006 at 2:30pm in Fairfax, VA.

The reason for transferring my 485 case to local office was I have been arrested once. Thats why.

The District Adjudicating Officer called me inside at 2:20pm and took mine and my wife's index printing on two forms and took me inside his office room. I hired a local immigration attorney who is not my original immi attorney. He asked each and every point on my case regarding arrest, tax returns, pay stubs, Employment Verification Letter, Date of Birth Certificate, etc...The interview was for exactly 1 hour long. He didn't ask my wife any single question. But the officer was very nice enough. Initially I thought my case might be complicated with him. Since he is a very cool guy my case went smooth and finally he said that there are no Visa Numbers Available for me and my wife he cannot stamp our passports.

We both came out with very happy and joy. The most tension part was done on my case.


PD : April 27, 2001 (EB3 India) (filed in ATL, GA)
I485 : October 28, 2002 (filed at TSC)
Transfer Date : July 11, 2006 (to Fairfax, VA because I live in VA)
Interview Date : September 21, 2006
 
Seems, the inquiry process has changed a bit. I initiated an enquiry with the NSC on Wednesday and the customer rep. I spoke with asked me if I and my wife have been scheduled for an interview at the local office. I answered no and asked if the case status have any additional details regarding an interview, however, received an email the next day stating my case is under review and as for my wife's case, the email stated it's waiting for an visa number.

Were there any additional questions besides paystubs,Tax-Returns, etc.,.?
