A good question..

As you might know, I am in the final(???) days of 485 approval. I am joining my client soon. I cannot take any vacation for probably another year or so. It is already 2 1/2 yrs since my last visit to India. So, we want to make a trip before I join this client. I do not have advance parole.
So, here are my questions:

1. How long does it take these days for AP approval?
2. Is there any risk in travelling with AP at this stage ? Will they transfer my case because of AP ?
3. Should I just block tickets for Feb, don't apply for AP and cancel the booking if my GC is not approved by then?
4. I feel sick of this whole GC process. It has put me in this worst kind of scenario that after 16 month of 485 receipt date, I have to ask the above questions.

Thanks,

hi roran,
firstly, i undesrstand your plight and your feelings to towards the GC process. In my opinion you should get an approval for your 485 by mid feb. I would just block tickets for end feb and avoid rocking the INS boat by applying for AP....
just my opinion...and i wish you the best.

Thanks for the reply..

I just called the IIO. This was to make sure whether they tranferred my case to local INS/not. The IIO first asked me whether I received the 181 card. I asked her "What is 181 card" ?
She checked the system and said that they mailed the 181 card on Nov 29'2001. Wow !! I should have got my GC along with my first EAD.
Then I clarified my EAC number again and she said that my case is still pending(Thank God !!Not transferred !!)
I asked her about the additional security check and she replied that it has been completed and that she cannot give an estimate about approval. I said "Thanks" and hung up.
I am still confused whether to apply AP or not.
How long does it take now to get AP???

My advise to you would be to apply for your AP. IT takes roughly around the same time as the EAD process. I don't know if you can do same day AP somewhere, never had to. Try and find that out from your lawyer. I don't think you'd be rocking any boats by having those documents with you.
In my case EAD & AP took around 2 months. It is diff. from case to case basis.

You may try calling Baltimore INS office and find out whether they issue AP on the same day. I beleive you need to give genuine reason for ur abroad travel inorder to get the AP on the same day..

If I were you, I will ask someone in India to catch hold of a doctor and fax me a lettter stating some is sick and ur travel is important. This might work at INS office and they will issue AP on humanitarian grounds.

then, what is this 181??

'cos the IIO was repeatedly telling me that they mailed me the green card on blah..blah..

PL WAIT

Hi Roran,
I was exactly in the same boat. My previous A/P had expired in Nov 2002 and I had not renewed it , hoping that my approval would come thru any time..I got an RFE on OCT 31 and replied back on NOV14th. My current project is getting over this month-end and I was planning a vacation to go to INDIA.
I called the IIO last monday to get an update and she told me that things are slow and it was hard to say when it would get approved. So I applied for a new AP last thursday with $220 for my wife and self to the INS. And Lo and behold, friday morning I see that my 485 has been approved.!!!
I have not bothered to cancel the money orders or do anything of that sort..
So pl wait..The IIO's dont really give you a clear picture of what exactly is happening..Instead of applying for A/P and waiting - you are better off waiting for the approval - and plus save the $220...Now that the darn freeze is over, you should not be too far off..GOOD luck !
