Hello All,
I am seeking information regarding my H-1B visa situation and possible pathways to return to the United States to resume my employment.
My Current Situation:
I am an Indian citizen and was working in the United States on an H-1B visa for a Healthcare company in California.
I have a master's degree from Pace University in New York (Graduated in 2021).
My H-1B extension petition (I-797) has been approved on Jan 20th 2026.
My prior H-1B visa stamp expired on September 30, 2025. Previously issued H-1B visa (Issue date: 27 Jan 2023 to Expiration date: 30 Sep 2025)
I recently travelled to India for a family emergency - my three-year-old nephew passed away, and I am currently here.
I do not have a valid H-1B visa stamp at this time, and I need to have my visa re-stamped to travel back to the U.S. to resume my employment.
I have no prior visa refusals, and this is not a first-time H-1B stamping.
Primary Question – Canada Third Country National (TCN) Stamping
Due to extremely limited appointment availability for H-1B stamping at U.S. consulates in India, I am exploring whether it is possible to schedule an H-1B stamping appointment at a U.S. consulate in Canada as a Third Country National (TCN).
It would be great if I could get some guidance here:
1. Are U.S. consulates in Canada currently accepting H-1B visa stamping applications from Indian citizens as Third Country Nationals?
2. If so, is it advisable to apply for an H-1B stamping while visiting Canada on a visitor visa? What are the specific requirements and eligibility criteria for visitor visa holders to Canada to apply for an H-1B stamping?
3. Are there particular consulate locations in Canada that are more receptive to TCN H-1B stamping cases?
4. What risks or common reasons for refusal should I be aware of with this pathway?
Additionally, my manager informed me that some of her Chinese friends got their H-1B stamping done in Canada in Jan 2026. Hence, my inquiry here.
