my wife came to the U.S. from the Philippines 3 yrs ago on a fiance visa she did not marry him recently we got married she has been illegal for 2 yrs what do we have to do to make her legal :(
 
hmm - don't quote me on this, but for employment based cases if you have been out of status for 180+ days you have a $1000 fine to pay - perhaps there is something similar possible in your case? Ask around - being a US Citizen yourself will probably help - that is if you are one.

You need professional help and this all should have been considered BEFORE you got married. INA Section 245(d) states that the ony basis that a K-1 fiancee may adjust status is marriage to the K-1 petitioner. Professional advice is necessary at this point to determine if there is any way for your wife to stay in the US for the next ten years. More than 365 days of unauthorized presence triggers a ten year bar to reentry and your wife is currently illegally present so she is therefore deportable.
